Limited Lifetime Warranty
AMD hereby warrants against defects in materials and workmanship of the Acuity Size 1 (SKU 005-00123-LTW) and Acuity Size 1.5 (SKU 005-00124-LTW) Digital Intraoral Sensors (collectively referred to herein as “Product”), for the useful expected service life of the Product which is here defined as five (5) years from the date of first use (“Lifetime”).
This warranty shall be in effect as of the date of purchase only by the original end user of the Product. This warranty provides for up to two (2) free replacement Products of the same or equivalent model, during the Lifetime of the original purchased Product. This warranty shall not extend, reset, or commence anew based on the date of receipt of any replacement Product provided under this warranty. The delivery of either or both of the free replacements shall be at no cost for the product, the owner will only pay shipping and handling. In addition to the two free replacement Products, the original purchaser is entitled to purchase additional replacement Product at an amount of $995.00 U.S. Dollars during the remainder of the Lifetime of the original purchased Product.
Coverage under this Limited Lifetime Warranty shall include defects in materials of construction and workmanship of the Product under normal conditions of clinical use, and shall include such defects as may be evident in the physical condition or performance of the Product, or in the quality, nature, or integrity of x-ray exposure images captured by the Product. This Limited Lifetime Warranty does not apply to Product where defects result from deviations from the Product instructions for use, with regards to: intended purpose and application of the Product; and proper care, cleaning and handling of the Product. This Limited Lifetime Warranty does not apply to Product that has been disassembled, accessed, modified, repaired, or tampered with beyond maintenance and care instructions defined in the Product instructions for use. This Limited Lifetime Warranty does not apply to Product that exhibits wear or damage inconsistent with normal clinical use. This Limited Lifetime Warranty does not apply to Product submitted for courtesy review, examination, or calibration of the Product not related to a declared defect. This warranty does not cover, and AMD is not liable for, any loss of revenue incurred due to the Product requiring replacement, repair, or servicing. The owner/user of the Product is required to read the Product instructions for use in full prior to use of the Product, and the owner/user accepts all liabilities and risks associated with use of the Product. This warranty is valid only to the original end-use purchase and is not transferrable.
AMD reserves the right to request return of the Product for examination of the purported defects. This warranty is voided if anyone other than an AMD authorized service center performs service, calibration, or repair of the Product not described in the Product instructions for use. In the event that the owner/user informs AMD of Product defects and the owner/user of the Product does not cooperate with AMD to accommodate repair, servicing, or replacement of the Product, this warranty shall be voided relative to such original defects and to all subsequent defects resulting from the continued presence of the original defects or continued use of the Product with the original or new defects. Additionally, AMD is not liable for any death, injury, or property damage traceable to continued use of the Product with a defect present that is knowingly unaddressed by the owner/user. This warranty holds supremacy to any other agreement, guarantee or warranty, oral or written, expressed or implied, except such written agreements issued directly by AMD and mutually entered into between AMD and the ultimate owner/user of the Product.
AMD reserves the right to make changes in design or to modify the Product subsequent to its original manufacture. Under this warranty, AMD will make best efforts to provide a replacement that is at least equal to the original purchased Product. AMD reserves the right to amend or modify this Limited Lifetime Warranty, with such amendments or modifications enforceable on Product shipped on or after the date such amendments or modifications are published.
Initial Satisfaction Guarantee
If you are not satisfied with the Acuity sensor, AMD extends the opportunity to obtain a full refund of the purchase price of the Product (not including transaction fees, shipping, etc.) when ALL of the following conditions are met:
- The Product is returned to and arrives at AMD within 30 calendar days from the date of purchase;
- The Product is returned with all accessories and packaging originally shipped with the Product (minus consumables that may have been used); and
- All aspects of the Product, including accessories, documentation, and packaging are free from any damage;
If slight damages or a significant reduction in consumable items are identified, a refund may be provided for the purchase price discounted by 15% to cover reconditioning, replenishment of consumables, replacement of damaged items and restocking. If extensive damage is identified, the refund may be further discounted to offset the cost of damages. Notwithstanding, no refund is offered if more than 30 days has passed since the date of purchase.
Returns & Replacements
To arrange for return or replacement, please call the AMD Customer Service at (866) 999-2635, or visit our AMD Service Portal at https://www.amdlasers.com/pages/amd-lasers-service-portal, to obtain a Return Material Authorization (RMA) number for shipping purposes. Product sent to AMD without an RMA may result in delays in processing, exclusion from the Limited Lifetime Warranty, or denial of services. Please ensure that the RMA number is clearly marked on the box used to return the laser. It is recommended that you return your Product in its original shipping box. Please clearly state the reasons for return.
